A Resolution Supporting The Expansion Of The Student Code Of Conduct

Purpose: To support the changes to 200.010 of the Collected Rules and Regulations for the University of Missouri System.

WHEREAS, the Student Code of Conduct identifies behavior that isn’t compatible with the University’s functioning as an educational institution; AND

WHEREAS, students agree to uphold certain standards by enrolling at the university; AND

WHEREAS, the offenses outlined below were not violations of student conduct until these changes were enacted; AND

WHEREAS, threats of violence, non consensual sexual behavior, stalking, harassment, invasion of privacy, and participating in attempted or actual theft are now violations of the Student Code of Conduct; AND

WHEREAS, non consensual sexual behavior is defined as “including but not limited to rape; sexual assault; non consensual sexual touching of the genitals, breast or anus of another person or the touching of another with one’s own genitals whether directly or through the clothing; or exposing one’s genitals to another under circumstances in which he or she should reasonably know that his or her conduct is likely to cause affront or alarm, or sexual harassment”; AND

WHEREAS, stalking is defined as “…another by following or engaging in a course of conduct with no legitimate purpose that puts another person reasonably in fear for his or her safety or would cause a reasonable person under the circumstances to be frightened, intimidated or emotionally distressed”; AND

WHEREAS, harassment is defined as “…engaging in a course of conduct directed at a specific person that serves no legitimate purpose that would cause a reasonable person under the circumstances to be frightened, intimidated, or emotionally distressed”; AND

WHEREAS, invasion of privacy is defined as “…by photographing or recording (using electronic or other means) another person in a state of full or partial nudity in a place where one would have a reasonable expectation of privacy without that person’s consent, and distributing or transmitting that image without that person’s consent”; AND

WHEREAS, these additions to the Student Code of Conduct uphold the excellence of conduct we, as students, expect from ourselves; AND

WHEREAS, the Chancellor Standing Committee for Student Conduct is tasked with formally hearing cases that violate the Student Code of Conduct and can now levy sanctions if students are found responsible for these acts.

THEREFORE BE IT RESOLVED BY THE MISSOURI STUDENT ASSOCIATION SENATE that the Missouri Student Association support the changes to 200.010 of the Collected Rules and Regulations for the University of Missouri System.

THEREFORE BE IT FURTHER RESOLVED BY THE MISSOURI STUDENTS ASSOCIATION SENATE that a copy of this Resolution be sent to the Senior Coordinator of Student Life, Director of Student Life, the Chancellor and the University of Missouri Board of Curators.
