An Act to Specify MSA Compliance with Federal and State Minimum Wage Requirements and to Specify Amendment Requirements to Section 4.50 Part (A)

WHEREAS, the Missouri Students Association currently compensates nine officer positions for their duties within the Association, totaling thirteen paid students and,

WHEREAS, the Missouri Students Association uses the University of Missouri’s pay scales to determine payment for those paid positions, and

WHEREAS, the pay scales used by the University are affected by the changes in Federal and State Minimum Wage Laws, and

WHEREAS, the changes to the Federal and State Minimum Wage requirements occur frequently, and

WHEREAS, in order to change the MSA By-Laws requires an Act introduced in the Senate, and,

WHEREAS, a yearly expected change in the pay scales of the Association can be more expeditiously handled, and

WHEREAS, Section 4.50 (C) states: EFFECTIVE DATES–No amendments to any officer’s salary listed in 4.50(A) shall become effective until the beginning of the next fiscal year, unless such changes are mandated by state or federal law”   and,

WHEREAS, there should be a method described in the By-Laws on how to handle compliance with the Federal and State Minimum Wage requirements, as well as authorization for the Senate to more efficiently comply with the changes enacted by the requirements in association without having to initiate a new act every time there is a mandatory change in wage regulations.

THEREFORE BE IT ENACTED BY THE MISSOURI STUDENTS ASSOCIATION SENATE that Section 4.50 of Chapter 4 of the By-Laws be amended by the addition of the following sections:

4.50 Compensation of Officers

(D) Compliance with Federal and State Wage Laws – In compliance with Federal and State Minimum Wage laws, Part (A) of Section 4.50 shall be automatically updated to reflect the Association’s compliance with the changes in both the Federal and State Minimum Wage Laws and as directed by the University of Missouri’s wage standards, at the time of the change in the officer’s pay as directed per Part (C) of Section 4.50.

(E) Amendments to 4.50 (A)–Changes to 4.50 (A) that affect the pay of an established position due to the reasons outlined above, which include the required Federal and State Minimum Wage and University Pay Standards, shall not require legislation from the Senate in order to take effect.
