47-28: A Resolution in Support of the Reduction of Credit Hours Necessary for Disabled Students to Declare Full-Time Status

WHEREAS, The Office of Disability Services, under the direction of Interim Director Barbara Hammer, has proposed the following policy:
An otherwise qualified student having a disability as defined by Title II of the Americans with Disabilities Act who is determined to be, due to disability, unable to carry a minimum of 12 credit hours or equivalent (for graduate or professional programs) shall be considered by the University of Missouri to be a full-time student and shall be considered to be making satisfactory academic progress while carrying a minimum of 9 credit hours for undergraduate and 6 credit hours or graduate or professional programs, and

WHEREAS, The American’s with Disabilities Act and Section 504 of the Rehabilitation Act of 1973 mandate that institutions of higher education must make “reasonable accommodation” to the usual academic requirement for students with disabilities, and
WHEREAS, The policy is written to be consistent with Section 504, which states that academic adjustments include “changes in length of time permitted for the completion of degree requirements…”, and
WHEREAS, Many federal, state, institutional and privately funded financial aid programs specify that students be of full-time status to receive any monetary aid, and
WHEREAS, Many insurance companies specify that college students be enrolled “full-time” in order to be considered for secondary coverage under a parent and/or guardian, and
WHEREAS, Some disabled students do not have the physical endurance to complete a full 12 hours of coursework in a single semester, and
WHEREAS, The Office of Disability Services, a Division of Student Affairs, would determine which disabled students would be eligible for such a program in accordance to the Americans with Disabilities Act of 1990.
Therefore, Be it resolved by the Missouri Student Association Senate, for the aforementioned reasons, to support the proposed policy that would allow disabled students that meet the predetermined criterion, to be considered full time students with a minimum of 9 credit hours for undergraduates and 6 credit hours for graduate students, and
Therefore, Be it further resolved by the Missouri Student Association Senate that the policy be approved effective for Fall Semester 2008 and that Article VIII, Section 1 (Definitions) of the Faculty Handbook be amended to include the following:
Reduced course load/ full time status as an accommodation: An otherwise qualified student having a disability as defined by Title II of the Americans with Disabilities Act who is determined to be, due disability, unable to carry a minimum of 12 credit hours or equivalent (for graduate or professional programs) shall be considered to be making satisfactory academic progress while carrying a minimum of 9 credit hours for undergraduate and 6 credit hours graduate and professional programs. For a student to qualify for this status, he or she must be registered with the Office of Disability Services and have the accommodations approved.
