46-60: An Act to Ensure the Right of a Presidential Slate to Request the Recusal of Justices

Purpose: To renew the current recusal process by allowing slates to petition the Court for the removal of a justice (s) for a particular case.
WHEREAS, the slates, with their briefs submitted to the Court, may attach an addendum requesting that a justice recuse him/herself from the case which he/she would either do voluntarily or by means of a voting procedure of Court as to be specified by the Student Court handbook, and
WHEREAS, although the Court has already established a procedure in requesting the recusal of judges, it should be ensured by MSA law that a slate shall always have such a right, and
Therefore, be it resolved that Presidential Slates are able to petition the Court for the recusal of a justice (s) when submitting their briefs and the issue will be decided by the by-laws of the Court and 5.50 (A) shall be amended to included:
5.50 (B) (9): Either party reserves the right to request the recusal of a Student Court Justice as per the process determined by the MSA Student Court
